CLOVIS, N.M. (KRQE) - A New Mexico family is suing after they say a police officer who was supposed to
perform a welfare check, instead allowed his dog to attack a man for no reason. The lawsuit, filed two
weeks ago, names two officers, the chief, and the Clovis Police Department as the defendants.
According to the lawsuit, in February, a woman called police saying her son was "suicidal." Three
officers responded, including K-9 Officer Brent Aguilar and Sgt. Travis Loomis.
The lawsuit states that when officers went to speak to him, the man told them he was okay but
refused to let them in the apartment.
The family's attorney said officers had their lapel cameras on, and that you can hear them planning to
release the K-9 on the man even though they reassured him that he wasn't in any trouble and that they
didn't want to hurt him.

Aguirre, Michael Silver City. (GCSO) Grant County Sheriff’s Office. Deputy-Sheriff. Issues 201-2018. Was working as an

2018/08/07--http://www.scdailypress.com/site/2018/08/07/former-deputy-sentenced-to-10-years/
Excerpt: Former Grant County Sheriff’s Deputy Michael Aguirre was sentenced to 10 years in prison
Monday for a series of violent domestic assaults he committed last year. But the state agreed that his
charges wouldn’t be classified as serious violent felonies, meaning he can earn up to 50 percent good
time off his sentence — and could be released in as few as five years. Aguirre, who served 20 years
with the Grant County Sheriff’s Office, followed by a stint with the Western New Mexico University
Police before his legal troubles began last year, was facing up to 26 and a half years in prison on 13
charges in four separate cases, according to a plea agreement presented Monday in District Court.
Sentencing was to be at the discretion of the court, and could have been as little as probation or up to
26 and a half years, but the state agreed to a cap of 10 years. Aguirre’s defense attorney, Daniel Dietzel,
argued for a sentence of probation with inpatient treatment, and said his client was waiting on a bed
at Men in Recovery or another long-term inpatient treatment program. He presented letters from
Aguirre’s wife, parents, aunt and uncle, and the forensic evaluation and a report from Mesilla Valley
Hospital. “What the family wants — and that includes a lot of the victims,” Dietzel said, “is they want
him to get help, and that is inpatient treatment.”

Excerpt from New York Times-2006/03/17: But the district attorney, Scot D. Key, said he had had no
choice: "It goes without saying that when you have a videotape that clearly shows a police execution,
it's just screaming for prosecution."If Sergeant Anders had not agreed to plead guilty, Mr. Key said,
federal prosecutors, concerned about the possibility of acquittal by a state jury, were prepared to try
him under a civil rights statute that could have sent him to prison for life. His guilty plea carried a
sentence of up to seven years; the one year the judge gave him was the lightest possible term.

Incident involving Rosalia Martinez: Excerpt: A woman injured after being hit by an Española Police
officer’s vehicle while crossing the street, is suing the Española Police Department. Attorney Kimberly
Brusuelas, of the Fifth Street Law Offices in Albuquerque, sent a letter addressed to the Española
Police Department Administration, dated Jan. 12, giving them notice of a tort claim and demanding
evidence be preserved.
Paralegal Courtney Johnson of Fifth Street Law Offices said Brusuelas helped Rosalia Martinez file the
initial notice and demand, but is not representing her.On Jan. 23, Santa Fe-based Attorney Peter
Culbert sent a notice to Mayor Alice Lucero, informing her that Martinez was giving notice to the city
that she was filing a tort claim, after the Nov. 22 incident on Paseo de Oñate, involving Officer Anthony
Armijo…He said Armijo saw the couple, who was hesitating to cross the road, and he went left, to avoid
striking them directly, as they crossed. As a result, Armijo collided with the center median and a tree,
but not before clipping the woman with the passenger side mirror of his Ford Expedition.

Excerpt from Our Tax Dollars at Work: The police chief of the small eastern New Mexico town of
Vaughn resigned Wednesday, leaving the town with just one certified member on its police force — a
drug-sniffing dog named Nikka. Dave Romero, attorney for the town, said Wednesday that police
Chief Ernest “Chris” Armijo decided to step down after news stories reported that he wasn’t allowed to
carry a gun because of his criminal background. “He decided the attention was distracting,” Romero
said. State officials said Armijo couldn’t carry a gun since acknowledging that he owed tens of
thousands of dollars in delinquent child support payments in Texas. Armijo also faces new felony
charges after being accused of selling a town-owned rifle and pocketing the cash. Romero said Armijo
is working to clear up the latest case. He said Armijo has not ruled out seeking the police chief’s
position again if his case is resolved and the position is open.

Excerpt: Meantime, Chief Armijo hadn't been able to carry a firearm since pleading guilty in January to
failing to pay thousands of dollars in child support in Texas, a felony in that state.
"The law is very clear. You cannot be a convicted felon and be a police officer in New Mexico," said
Gordon Eden, cabinet secretary for the New Mexico Department of Public Safety.
The town got Armijo a Taser, but the embattled chief has also been fighting allegations of selling a
town-owned rifle and of using drug evidence to "train" Nikka.
