Excerpt: The defense in Davon Lymon’s murder trial hasn’t even started to call witnesses, but prosecutors
are already trying to undermine Lymon’s expected self-defense argument. Lymon is charged in the October
2015 shooting that killed Albuquerque Police Officer Daniel Webster. Lymon’s defense argued in opening
statements that Lymon shot Officer Webster because he was in fear of his own life. In the eighth day of trial
Friday, prosecutors called long-time APD Detective Todd Babcock to the stand.
Babcock testified about being called out to the scene of the shooting in the Walgreens parking lot at
Central and Eubank. The detectives says he interviewed witnesses and police officers, and prepared
warrants and looked for evidence—including a jacket Lymon was said to be wearing, which was never
recovered.But after several questions about his on-scene work, Babcock’s testimony quickly morphed into
answering questions about traffic stops in general. Prosecutors even asked Babcock why an officer would
step on a suspect’s foot during a traffic stop, something Officer Webster did to Davon Lymon the night he
was shot.“If I were to perceive that someone is about to try and run from me, as an attempt to at least slow
them down, possibly place my foot on their foot, so they have to get out from under my foot before they go,
and hopefully, within that split second or so, I can try and react in some way,” said Babcock.

10/19/10: Officers Drew Bader, Ramon Ornelas shoot and kill Daniel Gonzales
Location: Tucumcari: APD SWAT team members Drew Bader and Ramon Ornelas fatally shot 56-year-old Daniel
Gonzales after police said he threatened them with two shotguns during a 6-hour standoff at a home in
Tucumcari.
According to State Police, Gonzales was involved in a domestic dispute with his ex-wife at a Tucumcari residence.
The woman and her grandchildren were able to leave the home, but Gonzales stayed inside and only agreed to
talk to police officers through a screen door.
Tucumcari police turned the case over to State Police, who in turn asked for assistance from the Albuquerque
Police Department SWAT team.
At one point during the standoff, police said Gonzales stepped out onto the home’s porch armed with a shotgun. A
short time later he grabbed a pistol, rifles and ammunition, and pointed the rifle at officers, who took cover, police
said. After trying to negotiate with Gonzales by phone for more than an hour and a half, Gonzales stood at the
front door with shotguns in both hands and threatened police, police said. Bader and Ornelas fired at Gonzales,
killing him.

jury awarded the couple $1.6 million. The federal jury ruled that Las Cruces police officers Isaiah Baker and
Joseph Campa used unreasonably excessive force and violated the couples Fourth Amendment right. The
incident took place in January 2013 after Jillian Beck called police to report a disturbance with neighbors
around 10 p.m., according to the Las Cruces Sun-News. The New Mexico cops did not appreciate Jillian Beck
walking away from them after they responded to a neighborhood dispute, prompting an officer to grab her
arm, twist it behind her back and slam her to the ground, leaving her with a fractured arm as he planted his
knee on her back. When the woman lifted her head to console her four-year-old son who began crying, the
Las Cruces police officer slammed her face on a bed of rocks, leaving her with a broken nose and a bruised
and bloodied face. When her husband became alarmed, thinking his wife was choking on her own blood,
he walked up to help her, but he was also arrested. Las Cruces police officer Isaiah Baker then turned to a
female officer and bragged about his deeds, telling her that Jillian Beck “got thrown” and ended up with a
“face full of rocks.” “Cool,” the female officer responded, according to an audio clip that was heard during a
civil trial last week.

Baker says personal views expressed on his Facebook post do not affect his on-duty behavior. "I'm not bringing it

Baker briefly lost his job after a 2010 incident in which a man claimed he and four other officers used excessive

Baker, a 22-year veteran of Santa Fe city police, was elected president of the Santa Fe Police Officers Association
about a year ago. The union represents roughly 150 sworn officers and civilian employees, according to Baker.
Not every one of Baker's Facebook posts expresses his political views. For example, he routinely posts memorials
for fallen officers. He also occasionally shares personal news, including a photograph of the trophy he received
after the Santa Fe Police Department awarded him 2016 Supervisor of the Year.

Excerpt: On Sept. 12, New Mexico State Police Investigations Bureau agents arrested Balding, 35, for one count of
child solicitation by electronic communication device, the release read. Earlier that day, Homeland Security
Investigations (HSI) contacted New Mexico State Police agents informing them that an HSI special agent in
Minnesota posing as a 15-year-old female on the Whisper app was contacted by a male individual, later identified
as Balding, according to the release. "Balding, who thought he was talking to a 15-year-old female exchanged
photos and had sexually explicit conversations with the agent," the release stated.
State Police agents obtained an arrest warrant through the district court in Lincoln County and charged Balding.

Excerpt from Abq Journal: Daniel Barde, an ex-State Police officer accused of DWI and child abuse in July
2011, was sentenced to one year of supervised probation and community service after entering into a plea
and disposition agreement on Jan. 28 in Valencia County District Court. Police said Barde, who was off-duty
at the time, had bloodshot, watery eyes and smelled of alcohol when officers pulled him over on July 5, 2011,
on Interstate 25, near Mile Marker 190 in Belen. Police said Barde, who had been stationed in Chama,
performed poorly on field sobriety tests and shortly after, was booked into the Valencia County Adult
Detention Center.

into a full-time position with the cost savings from the demotions of the four officers. Blea was hired on
April 12 into a full-time, temporary position that allots him no benefits. His temporary hire was meant to fill
the position vacated by Esparza’s temporary promotion to sergeant on Jan. 18, 2014.
Gallegos said the approximate amount of funding in the budget he needs to move Blea from temporary,
without benefits, to full-time, with benefits, is $7,000. If the Department is able to open Blea’s position to a
full-time one, Blea will have to apply for the job and test for it, Gallegos said. While Blea might have to
reapply for the position he currently holds, Officer Jose Martinez is still on administrative leave with pay
after he was arrested by State Police, Oct. 14 in Arroyo Seco, on a charge of aggravated drunk driving. He
allegedly refused to take a blood-alcohol level test, resulting in the aggravated charge.

site.The 32-year-old Mata told the paper the money paid by the city will be split among himself,
Gregoria Mora, Francisco Mata and Rene Barraza-Mata, all of who claimed they were battered on Nov.
29, 2002, by five police officers — Mike Briseno, Kenneth Raybon, David Monfils, Wilson Charley and
Jerry Vigil.
Farmington City Attorney Jay Burnham confirmed the settlement but denied any culpability on the
city’s part."The making of such an offer should not be construed to mean that the city felt that its
officers had done anything wrong," Burnham told the Daily Times. "The city specifically denies that
the plaintiffs were mistreated or harmed in any way."

Excerpt from The New Yorker (02/02/2015: Brown had already been rejected by the Albuquerque Police Department, in
1995, because he had bad credit, which was seen as a sign of recklessness. He ended up in the Roswell Police
Department, three hours south of Albuquerque. While he was there, a city councilor brought a civil-rights lawsuit
against him—she alleged that he had arrested her for exercising her right to free speech—and five citizens filed
complaints. He was accused of injuring a man by throwing him to the ground; of humiliating a mother when
arresting her for speeding; and of pointing his gun at someone who got out of his car too slowly. Later, he estimated
that he had drawn his gun during a traffic stop on at least ten occasions. In 2005, he applied to work for the police
department in Rio Rancho, just north of Albuquerque, but he was rejected for having a bad attitude. Since the last
time he applied to the Albuquerque Police Department, Brown had been in two car accidents and filed for
bankruptcy—events that the department typically considered indications of instability—but his second application
was accepted, and he was given a signing bonus of five thousand dollars. He didn’t take a psychological exam. His
training lasted six weeks…[after a struggle with Christopher…) Brown unholstered his pistol, a nine-millimetre
handgun that he’d owned since he was sixteen. He pressed the muzzle against Christopher’s back and pulled the
trigger. He didn’t hear any noise, and wondered if the gun had malfunctioned. He squeezed the trigger again. This
time Christopher said, “Ow.” Christopher was still trying to get up, so Brown shot him in the back a third time. KRQE

According to authorities, Detectives C.J. Brown and Richard Hilger shot Torres in the back at close range while
serving an arrest warrant on a felony charge of aggravated auto burglary for trying to carjack a woman at a traffic
light. During the confrontation with police, Torres tried to punch Hilger and grabbed his gun as they scuffled in the
suspect's backyard, police said.
But Bacon said the officers did not present the arrest warrant when they confronted Torres in his yard.
