The woman said the assault by Sgt. Kent O'Donnell occurred at her home in Farmington on August 27. But she feels local authorities aren't taking her seriously and she has filed additional complaints with the city's Community Relations Commission and the Navajo Nation Human Rights Commission. "My client — she is Navajo — really was seeking the support of her own people," attorney Brigitte Thomas told The Farmington Daily Times. "She wanted the backing of a Nation, which makes her feel stronger because she is going up against a police department. She feels small, she feels overwhelmed. And because we believe there is a pattern of discrimination by (O'Donnell) of harassing ... pretty young Navajo or Hispanic women." O'Donnell has been placed on administrative duty but no charges have been filed. Another Navajo woman previously accused him of entering her home while she was in the shower but the police department found the complaint was unsustained. https //www indianz com/News/2011/11/28/indian-woman-accuses-police-of asp Casetext dot com https //casetext com/case/us-v-kennelley Excerpt: 1. Kent O'Donnell has been a police officer with the City of Farmington and County of San Juan in the State of New Mexico for seven years. 2. On December 29, 2004, Officer O'Donnell was assigned to the street crimes unit of the City of Farmington Police Department. 3. The street crimes unit is a "proactive" unit that specifically goes out looking for street-level drug dealers, repeat offenders, and gang members. 4. As a member of the street crimes unit, Officer O'Donnell's responsibilities included, among other things, dealing with gang crimes and gang activities and doing hotel and drug interdiction. 5. Hotel and drug interdiction involves specifically targeting hotels and motels for the investigation of drug activity. 6. On December 29, 2004, Officer O'Donnell was on duty with his partner, Officer Mike Briseno. 7. Officer Briseno has been employed by the City of Farmington Police Department for five years. 8. Officers O'Donnell and Briseno normally worked the 5:30 p.m. to 3:30 a.m. shift, and were doing so on December 29, 2004. 9. In the early morning hours of December 29, 2004, Officers O'Donnell and Briseno were patrolling the Rim Rock Lodge Motel, an overnight and extended-stay motel, on Bloomfield Road in Farmington. 10. Cynthia Orr gave a media interview, starting out, “This is probably going to end my career.” Orr said Chief Gilbert Gallegos failed to act despite repeated warnings of evidence theft. Orr said that, in Aug. 2003, she identified two people who were stealing in the evidence room, but Gallegos allowed them to continue to work there, which enabled them to destroy evidence that would have proven their guilt. She said she discovered thefts when property went to auction and the list of property taken out of the evidence room was longer than the list of property the auctioneer received. "Am I implicating the chief is assisting to do this cover-up? Absolutely. Do I know this is a dangerous accusation to make? Absolutely. But I know this is something that needs to be done." Orr said a deputy chief forbade her to send reports of missing evidence to the records department, because they didn’t want it to become public record that things were missing. She said officers under criminal investigations for such things as DUI or domestic violence were allowed to work in the evidence room where they could oversee the evidence in their own criminal cases. http //www realcrimes com/Corruption_Overview htm Orta, Refugio Socorro, Socorro PD/Sergeant, Alleged official oppression during investigation by Texas Rangers, - KVIA Articles KVIA https //www kvia com/news/names-of-socorro-police-officers-arrested-have-been- released/55619331 Ortega, Anthony Santa Rosa, (06/11/2002), , Real Crimes-2002/06/11 From Real Crimes: “6/11/02 Troy Pino’s Suspicious death (Santa Rosa PD): The first officer at the scene was Lucero’s nephew, Officer Justin Anaya. In the year 2000 there was an incident involving two male Hispanics who drove a Ford camper truck - see below for more details. Watch for antics: possible skewed material on either side of a police/suspect racial/cultural divide. This issue probably deserves additional review and investigation. Two suspects named Leroy Rael and Glenn Garduno are involved in the 2000 Matt James video and incident below. Perhaps Glenn Garduno is the speaker behind the toy frog pantomime in the video below, given the emotional expressionism. More detailed notes: A July 20, 2011 HuckleB680 submission of an earlier Matt James 2/2000 Youtube video on the internet seems to be a possible spoof (or a psychologically disturbed revisionist history) of the actual incident; this video shows the officer doing one thing; the possible actual news clip/video shows something else - namely, that he was operating professionally, self-protective and calm against great odds, including being out-numbered, as the suspects were talking back to him and one grabbed a shovel from the back of their truck to try to attack him. The other possibility is the “actual clip” has been faked in some way, but the material “Cop Fights Two Men” seems pretty authentic. If it is not authentic, another officer scene has been cut and pasted into the original material and perhaps this then is a spoof by a far right group. One possible red flag the Matt James video is authentic is that its submitter shows a link to the actual news case as if trying to back up the material with actual fact; it is unlikely the submitter would optimistically send people to a link that gives the other side of the story. We thus need to check for other older, more original news clips than the one listed below in case it has been dubbed in. In either case, we should keep our eyes open to the possibilities. The speaker on the Matt James video seems genuinely upset in his replay of the incident, and we cannot ignore that level of emotion as mere faked outrage. However, people can make up stories against officers with a sense of group culture with an “us against them” mentality against the United States. If the Matt James video is revisionist history, it can enlighten us more as to certain Hispanic approaches - that is, those with an adamantly anti-American world view and mindset. Since one of the suspects later is listed as killed by a gang in the Matt James material, we can ask if in addition to possible far right groups, gangs are involved in any revisionist histories or remakes of an original film. Thus we need to consider the innocence and propriety of the police officer involved, with guilty Hispanics using one-sided emotionalism and anti-Americanism to project a false image of the officer, or whether something is fishy in the imagery of the news story, whether it is has been dubbed over. Teaching Tool: This material might be good material to be used as a teaching tool to flesh out the possibilities of police/suspect and Hispanic/Anglo interactions in New Mexico by looking at who could be innocent/victimized in either case. Matt James video - a plastic toy frog pantomime video of an actual police event involving Christopher Oskins Deadly Corrupt Force: the Questa officer incident; a film by Matt James- Questa, New Mexico 2/1/2000 https://www.youtube.com/watch?v=K6XZbNZphzA HuckleB680 submitted this video Excerpt: (Comments from the 2011 HuckleB680 submission): This is a short film about a legal incident that most people have never heard of, but is interesting. In Questa, New Mexico throughout the year 2000, there was a police officer named Chris Oskins who had many incidents of alleged abuse towards people and used excessive force against them. The most infamous case was on Feb 17, 2000 when Oskins pulled over these guys (named Leroy Rael and Glenn Garduno) driving a truck and violated their constitutional rights during the traffic stop. After 4 months in jail and being let out early for good behavior, the men sued the village of Questa and tried to get Chris Oskins fired. The judge and hundreds of citizens agreed with Rael and Garduno and thought Oskins was abusive and a jerk. The judge of Taos County soon ruled that Oskins DID act unreasonably harsh towards them along with 11 people since 1998, and dropped all criminal charges against the suspects. Soon after, the governor of New Mexico pardoned Rael and Garduno of all charges and let them get back to their normal lives. Garduno is known for making SEGA video game playthroughs on YouTube under the username HyperSonic7701. Rael was unfortunately assassinated by gang members in 2008. Oskins retired in 2002 (thank god!). Everything is illustrated in this video as well as a clip from the TV Show "Most Shocking". A link to that video is here: http://www.youtube.com/watch?v=jjQetI...
